Terms and Conditions for Waste Clearance Kensington Services

These Terms and Conditions set out the basis on which Waste Clearance Kensington provides waste collection and related services to domestic and commercial customers. By booking a service, you agree that you have read, understood and accepted these Terms and Conditions, which form a binding agreement between you and Waste Clearance Kensington.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, company or organisation that books or receives services from Waste Clearance Kensington.

Services means any waste clearance, rubbish removal, waste collection, bulky item removal, recycling or associated services provided by Waste Clearance Kensington.

Waste means any items, materials, junk, rubbish or refuse that the Customer asks Waste Clearance Kensington to remove, subject to applicable waste regulations and these Terms and Conditions.

Contract means the agreement between the Customer and Waste Clearance Kensington incorporating these Terms and Conditions and the details of the booking.

2. Scope of Services

Waste Clearance Kensington provides waste collection and clearance services, including the removal and lawful disposal of domestic and commercial waste, subject to applicable law and these Terms and Conditions. The exact nature of the service, including type and estimated volume of waste, collection address and any special requirements, will be agreed at the time of booking.

All Services are provided on the basis of information supplied by the Customer. Waste Clearance Kensington reserves the right to refuse any item or load which it reasonably believes cannot be handled safely, is prohibited by law, or falls outside the agreed description of the waste.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any other officially provided booking channel of Waste Clearance Kensington. A booking is not confirmed until Waste Clearance Kensington has accepted it and communicated confirmation to the Customer.

3.2 When placing a booking, the Customer must provide accurate and complete information, including:

a. Full name and contact details.

b. Collection address and access details.

c. Description, approximate quantity or volume, and, where relevant, approximate weight of the waste.

d. Any known hazards or special handling requirements, including electrical items, sharp or heavy objects, or potentially contaminated materials.

3.3 The price quoted at the time of booking is usually based on the Customer’s description of the waste and the estimated load size required. Waste Clearance Kensington may confirm or adjust the price on arrival if the actual waste differs significantly from the description given by the Customer. Where a price adjustment is required, the Customer will be informed before work begins and may accept the revised price or decline the Service.

3.4 By proceeding with the booking, the Customer confirms that they are the owner of the waste or have the owner’s authority to arrange for its removal and disposal.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that Waste Clearance Kensington and its operatives have safe and reasonable access to the property and to the waste to be collected at the agreed time and date.

4.2 The Customer is responsible for securing any required permissions, permits or access arrangements in relation to shared spaces, private roads, car parks, gated entries or controlled parking areas.

4.3 The Customer must ensure that the waste to be collected is clearly identified and separated from items not intended for removal. Waste Clearance Kensington will not be responsible for removing items that were not clearly indicated as waste, and the Customer will bear the cost of any additional retrieval or replacement where possible.

4.4 The Customer must disclose any hazards that may affect the safety of the operatives or the removal process, including hazardous or sharp materials, unsafe structures, or the presence of potentially dangerous substances.

5. Pricing and Payment Terms

5.1 Pricing for the Services is usually based on factors including load size, volume, weight, access, parking arrangements and the nature of the waste. Additional charges may apply for heavy loads, difficult access, restricted parking, or special handling and disposal requirements.

5.2 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Any applicable tax will be added to the final invoice.

5.3 Payment is due in full upon completion of the Service, unless otherwise agreed in writing before the Service is carried out. Waste Clearance Kensington may request a deposit or full pre-payment prior to attending the property.

5.4 Payment may be made by accepted card types, bank transfer or other methods specified by Waste Clearance Kensington. Cash payments may be permitted only where explicitly allowed and confirmed at the time of booking.

5.5 For business and account customers who are granted credit terms, invoices must be paid within the agreed payment period. Waste Clearance Kensington reserves the right to charge interest and reasonable recovery costs on overdue amounts in accordance with applicable law.

6. Cancellations and Changes

6.1 The Customer may cancel or amend a booking by contacting Waste Clearance Kensington as soon as reasonably possible before the scheduled collection time.

6.2 If the Customer cancels a booking with less than 24 hours notice, Waste Clearance Kensington reserves the right to charge a cancellation fee to cover allocated resources, administrative costs, and any non-refundable expenses.

6.3 If the Customer is not present at the property at the scheduled time, or if access cannot be obtained due to reasons within the Customer’s control, Waste Clearance Kensington may treat the booking as cancelled and may apply a call-out or cancellation charge.

6.4 Waste Clearance Kensington reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including severe weather, traffic disruption, equipment breakdown, staff illness, or safety concerns. In such cases, the Customer will be offered a new appointment time and no cancellation fee will apply.

7. Waste Types and Restrictions

7.1 Waste Clearance Kensington operates in accordance with UK waste management legislation and relevant environmental regulations. Certain items may not be collected or may require special arrangements, including but not limited to:

a. Hazardous waste such as chemicals, solvents, asbestos-containing materials, medical waste or flammable liquids.

b. Pressurised containers or gas bottles.

c. Certain electrical or electronic equipment that requires specialist treatment.

d. Items prohibited by law from normal waste collection channels.

7.2 The Customer must inform Waste Clearance Kensington in advance if any such materials are present. Where possible, arrangements may be made for specialist removal at an additional cost, subject to legal and safety requirements.

7.3 Waste Clearance Kensington reserves the right to refuse to collect any waste it reasonably believes to be unsafe, illegal, incorrectly described, or outside the scope of the agreed Service.

8. Waste Handling and Duty of Care

8.1 Waste Clearance Kensington will transport and dispose of waste in accordance with UK waste duty of care regulations and will only use appropriately licensed waste transfer and disposal facilities.

8.2 Once the waste has been collected and loaded onto Waste Clearance Kensington vehicles, ownership and responsibility for the waste transfers to Waste Clearance Kensington, except where the waste is later deemed to be prohibited, hazardous without disclosure, or not as described. In such cases, Waste Clearance Kensington may seek to recover any reasonable additional disposal costs from the Customer.

8.3 On request, and where legally required, Waste Clearance Kensington will provide the Customer with appropriate documentation evidencing lawful transfer or disposal of the collected waste, such as a waste transfer note.

9. Liability and Limitations

9.1 Waste Clearance Kensington will exercise reasonable care and skill in providing the Services. However, the Customer is responsible for safeguarding items not intended for removal and for ensuring that access routes are clear and safe.

9.2 Waste Clearance Kensington will not be liable for loss or damage arising from:

a. The removal of items that the Customer or their representative identified or appeared to identify as waste.

b. Pre-existing structural damage, weak surfaces, or defects in the property or fixtures.

c. Damage to driveways, paths or surfaces arising from the normal movement or positioning of vehicles and equipment, where access has been requested and granted by the Customer.

9.3 If Waste Clearance Kensington is found to be liable for direct loss or damage caused by its negligence, such liability will, to the extent permitted by law, be limited to the lower of the cost of repair or replacement of the affected property and the total price paid or payable for the relevant Service.

9.4 Waste Clearance Kensington does not exclude or limit its liability for death or personal injury caused by its negligence, or for any other liability that cannot be lawfully excluded or limited.

9.5 Waste Clearance Kensington shall not be responsible for any indirect or consequential loss, loss of profit, loss of opportunity or business interruption arising from the provision of the Services.

10. Customer Indemnity

The Customer agrees to indemnify Waste Clearance Kensington against all claims, costs, damages and expenses arising from:

a. Any breach by the Customer of these Terms and Conditions.

b. Any misdescription of the waste or failure to disclose hazardous or prohibited materials.

c. Any third-party claim relating to Waste that the Customer did not have the right or authority to dispose of.

11. Delays and Force Majeure

11.1 Waste Clearance Kensington will make reasonable efforts to attend the property and complete the Service at the agreed time. However, arrival times are estimates and may be affected by external factors such as traffic, accidents, or weather conditions.

11.2 Waste Clearance Kensington shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events or circumstances outside its reasonable control, including but not limited to extreme weather, industrial disputes, road closures, vehicle breakdown, acts of government or other force majeure events.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Service, they should notify Waste Clearance Kensington as soon as possible, providing details of the issue and any supporting information.

12.2 Waste Clearance Kensington will investigate complaints promptly and aim to provide a response or resolution within a reasonable time frame. Where appropriate, this may include a partial refund, re-attendance, or other remedial action at Waste Clearance Kensingtons discretion.

12.3 In the event of a dispute that cannot be resolved informally, the parties may consider mediation or other forms of alternative dispute resolution, without affecting their right to pursue legal remedies.

13. Data Protection and Privacy

13.1 Waste Clearance Kensington will handle personal data in accordance with applicable data protection laws in the United Kingdom.

13.2 Personal information collected for the purpose of providing Services, managing bookings and processing payments will be used only as necessary for these purposes and for related administrative and legal obligations.

13.3 The Customer is responsible for ensuring that any personal data they provide is accurate and that they have authority to share it.

14. Changes to Terms and Conditions

14.1 Waste Clearance Kensington may update or amend these Terms and Conditions from time to time. The latest version will apply to all new bookings made after the date on which the revised Terms and Conditions come into effect.

14.2 The version of the Terms and Conditions that applies to a particular booking will be the version in force at the time the booking was accepted by Waste Clearance Kensington.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any Contract between the Customer and Waste Clearance Kensington, are governed by and shall be construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to hear and determine any dispute arising out of or in connection with these Terms and Conditions or the provision of the Services.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court or regulator, the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by Waste Clearance Kensington in exercising any right or remedy under these Terms and Conditions shall be construed as a waiver of that right or remedy.

16.3 The Contract is between the Customer and Waste Clearance Kensington. No other person shall have any rights to enforce any of its terms.

16.4 These Terms and Conditions constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.

By confirming a booking and allowing Waste Clearance Kensington to carry out any waste collection or clearance service, the Customer acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.
